Article 1 Definitions

1.1 In these General Terms and Conditions, the following terms are used with the following meanings, unless expressly stated otherwise.

Le-Connaisseur: the user of the general terms and conditions.

Consumer: a counterparty on whose behalf and for whose account products are delivered.

Contract: the contract between Le-Connaisseur and the consumer.

 

Article 2 Applicability

2.1 These General Terms and Conditions (hereinafter: Conditions) apply to all offers, orders and agreements from Le-Connaisseur to the exclusion of all other General Terms and Conditions.

2.2 All rights and entitlements set out in these conditions and in all other agreements in favor of Le-Connaisseur also apply in favor of intermediaries and other third parties commissioned by Le-Connaisseur.

2.3 Accepting an offer or placing an order means that the consumer accepts the applicability of these general terms and conditions.

2.4 The provisions of these general terms and conditions can only be deviated from in writing, in which case the other provisions remain in full force.

2.5 Le-Connaisseur reserves the right to change or amend these General Terms and Conditions from time to time.

 

Article 3 Offers and conclusion of contract

3.1 Offers are valid while stocks last.

3.2 Le-Connaisseur cannot adhere to its offers if the consumer should have understood, in terms of reasonableness and fairness and generally accepted views, that the offer or part of it contains an obvious mistake or error.

3.3 A composite offer does not oblige Le-Connaisseur to supply part of the goods included in the offer at a corresponding part of the stated price.

3.4 Offers do not automatically apply to repeat orders.

3.5 Information, images, communications and explanations etc. provided orally, by telephone or by e-mail on all offers and the main characteristics of the products are (re)displayed or reproduced as accurately as possible. However, Le-Connaisseur does not guarantee that all product offers fully correspond to the information etc. provided. In principle, deviations cannot lead to damages and/or termination of contract.

3.6 A contract is formed as soon as an order confirmation is sent by email to the email address provided by the consumer.

3.7 Le-Connaisseur is entitled to refuse any order or contract or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order or assignment is not accepted, Le-Connaisseur will inform you as soon as possible after receiving the order.

3.8 Le-Connaisseur does not deliver wine products to persons under the age of 21. By ordering these products, the consumer declares that he is at least the stated age.

 

Article 4 Prices and Payments

4.1 The prices stated on the Le Connaisseur website include VAT. Shipping costs, offers, discounts, etc. are always calculated on the amounts including VAT.

4.2 The prices for the Products are as shown on the Le Connaisseur website, subject to price changes and typographical errors. Le-Connaisseur has the right to inform the consumer about price errors before delivery or acceptance.

4.3 Le-Connaisseur products are delivered at the prices applicable on the day of the order.

4.5 If you are in default with a payment, Le-Connaisseur is entitled to suspend or dissolve the relevant Agreement and related agreements (the execution).

 

Article 5 Termination of Agreement

5.1 Right of withdrawal: The consumer has the right to return the order (or parts thereof) within 14 working days of delivery without giving any reason. The prerequisite is that the original invoice is sent, the goods are undamaged and are still in the original packaging, i.e. no seal may be broken. The consumer must report the return in advance. This can be done by email ( info@Le-Connaisseur.nl ). Unregistered shipments will not be refunded. After the complaint has been accepted and the goods returned to Le-Connaisseur, the consumer will be reimbursed the full purchase price within 14 days at the latest. In the event of a return, the shipping costs are the responsibility of the consumer.

5.2 Le-Connaisseur reserves the right to refund part of the amount or to refuse the return entirely if there is a suspicion that the products have already been used or have been damaged after receipt by the consumer.

 

Article 6 Delivery

6.1 Unless otherwise agreed, delivery will be made from the Le-Connaisseur warehouse. Le-Connaisseur is not responsible for delays in delivery caused by the carrier used by Le-Connaisseur.

6.2 If the consumer refuses to take delivery or is negligent in providing information or instructions necessary for delivery, the items intended for delivery will be stored at the consumer's risk after Le-Connaisseur has warned him. In this case, the consumer owes all additional costs.

6.3 The delivery times indicated by Le-Connaisseur are indicative.

 

Article 7 Warranty

7.1 Le-Connaisseur guarantees that the goods to be delivered meet the usual requirements and standards that can be imposed on them and that they are free from defects.

7.2 The warranty mentioned under 7.1 applies for a period of ten working days after delivery. Within this period, product defects can be reported by email.

7.3 The proof of purchase serves as proof of guarantee.

7.4 It is possible that Le-Connaisseur contains links on its website to other websites that may be interesting or informative for the visitor. Such links are for informational purposes only. Le-Connaisseur is not responsible for the content of the website referred to or your use of it.

 

Article 8 Retention of title

8.1 Notwithstanding the actual delivery, the ownership of the products only passes to the consumer after he has discharged all debts he owes in connection with an agreement with Le-Connaisseur, including the reimbursement of interest and costs, also for previous deliveries and work carried out , has paid in full in respect of the Products.

8.2 The Consumer shall not tax, sell, resell, dispose of or otherwise encumber the Products before ownership has passed.

 

Article 9 Research, Complaints

9.1 The consumer is obliged to inspect the delivered goods at the time of delivery, but in any case within the shortest possible time. The consumer should check whether the quality and quantity of the delivered goods correspond to the agreement or at least meet the requirements applicable in normal (business) transactions.

9.2 All visible defects should be reported within three working days of delivery by email ( info@Le-Connaisseur.nl ) and the defective item, unless this is impossible or unreasonably onerous.

9.3 The consumer must report a non-visible defect to Le-Connaisseur within eight working days of discovery, but no later than within the warranty period, with due regard to the provisions of the previous paragraph of this article. After the warranty period has expired, Le-Connaisseur is entitled to charge for any repair or replacement costs, including administrative, shipping and call-out costs.

 

Article 10 Payment

10.1 At Le-Connaisseur, the personal data you provide for the purpose of payment will be treated confidentially.

10.2 If the consumer has to pay in advance, Le-Connaisseur will ship the goods within seven working days after receipt of the payment on our account if the goods are in stock.

10.3 Objections to the amount of the invoices do not suspend the payment obligation.

10.4 After 14 days from the invoice date, the consumer is legally in default. From the moment of default, the consumer owes statutory interest on the amount due.

10.5 Le-Connaisseur has the right to demand the payments made by the consumer first to reduce the costs, then to reduce the interest due and finally to reduce the principal and the current interest.

10.6 Le-Connaisseur may, without being in default, refuse an offer of payment if the consumer submits a different order for allocation.

10.7 Le-Connaisseur may refuse full repayment of the principal if the outstanding and accrued interest and costs are not also paid.

 

Article 11 Collection costs

11.1 If the consumer defaults or defaults on the fulfillment of one or more of his obligations, the consumer shall bear all reasonable costs of obtaining payment out of court.

11.2 Le-Connaisseur is entitled to assign the claim for collection if payment is not made.

11.3 In any case, the consumer owes extrajudicial collection costs in the event of a monetary claim. The extrajudicial collection costs are 15% of the principal amount with a minimum of €75.00.

11.4 If Le-Connaisseur proves that it has incurred higher costs that were reasonably necessary, these will also be eligible for reimbursement.

 

Article 12 Compensations

12.1 The consumer indemnifies Le-Connaisseur against claims by third parties in relation to industrial and intellectual property rights on materials or data provided by the consumer and used in the performance of the agreement.

 

Article 13 Intellectual property and copyright

13.1 You must fully and unconditionally respect all intellectual and industrial property rights in the Products supplied by Le-Connaisseur.

 

Article 14 Liability

14.1 If goods delivered by Le-Connaisseur are defective, Le-Connaisseur's liability towards the consumer is limited to what is set out under "Guarantees" in these general terms and conditions.

14.2 Le-Connaisseur is never liable for consequential damage.

14.3 Without prejudice to the above, Le-Connaisseur is not liable if the damage is due to intent and/or gross negligence and/or culpable action or improper or improper use by the consumer.

 

Article 15 Force Majeure

15.1 Without prejudice to its other rights, in the event of force majeure, Le-Connaisseur has the right, at its own discretion, to suspend the execution of the order or to dissolve the contract without judicial intervention.

 

Article 16 Applicable law and competent court

16.1 Dutch law applies to every agreement between Le-Connaisseur and the consumer.

16.2 All disputes relating to or in connection with offers from Le-Connaisseur or agreements concluded with Le-Connaisseur will be submitted to the competent court.

 

Article 17 Disclaimer

17.1 All prices, percentages and tariffs mentioned on this website are subject to possible errors and are subject to change at any time within the reach of Le-Connaisseur. Le-Connaisseur registers and stores the information you provide in a database.

17.2 The Le Connaisseur website and all texts, documents, images and sounds contained therein are protected by copyright in the broadest sense. Written permission is required for further distribution, publication or transmission. Le-Connaisseur excludes liability for any damage (direct, indirect and consequential) resulting from the use of the website and its contents. Le-Connaisseur maintains and secures the website and the content. However, Le-Connaisseur does not guarantee the absence of technical defects.
